A statement if impact demonstrates to the authorities what is happening in our community.
We are petitioning the Attorney General to get involved with this case, in order for that to happen we have to demonstrate the Attorney General has legal jurisdiction to do so. One easy way to do this is to demonstrate the slag dushing operation and resulting fugitive dust is:
- a public nuisance
- or injurious to health
- or offensive to the senses
- or an obstruction to the free use of property that interferes with the comfortable enjoyment of life or property by an entire community or neighborhood or by a considerable number of persons.
If we can demonstrate the aforementioned, we can likely compel involvement from the Attorney General, which is critical as the City of Cottonwood has a clear conflict of interest as they are being directly paid by the slag crushing operation and as a result, it appears their clear judgement on this matter has become clouded.
